Welcome to 345Cars. These Terms of Use ("Terms") govern your access to and use of the 345Cars website, marketplace, mobile applications, services and related platforms (collectively, the "Platform").
345Cars provides an online marketplace that allows individuals, dealers and other approved sellers to advertise and discover vehicles, including cars, motorcycles, boats and trailers.
By accessing or using the Platform, creating an account, submitting a listing, contacting another user, or otherwise using any 345Cars service, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Platform.
1. About 345Cars
345Cars is a marketplace that helps buyers and sellers connect.
Unless expressly stated otherwise, 345Cars is not the owner, seller, buyer, dealer, broker, agent or representative of any vehicle advertised through the Platform.
345Cars does not generally take part in negotiations, payments, ownership transfers, financing, inspections, delivery, registration or other transactions between users.
Any transaction entered into between a buyer and seller is between those parties. Users are responsible for making their own decisions and completing appropriate checks before entering into a transaction.
2. Eligibility
You must be legally capable of entering into a binding agreement to use the Platform.
If you are using 345Cars on behalf of a business, dealership or other organisation, you confirm that you have authority to act on behalf of that organisation.
You may not use the Platform if your use is prohibited by applicable law.
3. Creating an Account
Some features of 345Cars may require you to create an account.
When creating an account, you agree to:
- Provide accurate, current and complete information.
- Keep your account information updated.
- Keep your login credentials confidential.
- Not allow another person to use your account without permission.
- Notify 345Cars if you believe your account has been compromised.
- Accept responsibility for activity carried out through your account unless caused by circumstances outside your reasonable control.
345Cars may suspend or terminate accounts that contain false information or are used in violation of these Terms.
4. Vehicle Listings
Users who advertise vehicles through 345Cars are responsible for ensuring that their listings are accurate, complete and not misleading.
A listing should accurately describe the vehicle, including where applicable:
- Make and model
- Year
- Mileage or usage
- Vehicle identification number (VIN), where appropriate
- Condition
- Ownership status
- Asking price
- Location
- Registration information
- Known damage or material defects
- Modifications
- Relevant photographs
- Other information reasonably necessary for a buyer to understand the vehicle
For boats and trailers, sellers should provide relevant information such as make, model, year, dimensions, engine information, registration and other material details where applicable.
Sellers must not knowingly provide false, misleading or materially incomplete information.
5. Seller Responsibilities
By submitting a listing, you confirm that:
- You have the right or authority to advertise the vehicle.
- The information provided in the listing is accurate to the best of your knowledge.
- You will not advertise a vehicle that you do not have the right to sell or advertise.
- You will promptly update or remove a listing when the vehicle is no longer available.
- You will not use 345Cars to advertise stolen, unlawfully obtained or illegally modified vehicles.
- You will comply with all applicable laws and requirements relating to the sale, ownership, registration and transfer of the vehicle.
- You will communicate honestly and fairly with prospective buyers.
345Cars may request additional information or documentation to verify a listing or seller.
6. Vehicle Verification
345Cars may offer verification services or display verification indicators on selected listings.
A verification badge, label or other indication does not constitute a guarantee that a vehicle is free from defects, liens, accidents, mechanical problems or other issues.
Verification may relate only to specific information or documents reviewed by 345Cars and should not be interpreted as a complete inspection, appraisal, warranty or guarantee.
Buyers remain responsible for independently verifying the vehicle and seller before completing a transaction.
7. Buyer Responsibilities
Buyers should carry out their own due diligence before purchasing any vehicle advertised through the Platform.
This may include:
- Inspecting the vehicle in person.
- Checking the VIN and registration information.
- Confirming ownership and title.
- Obtaining an independent mechanical or marine inspection where appropriate.
- Confirming mileage and service history.
- Checking for outstanding finance, liens or other claims where applicable.
- Confirming that the seller has authority to sell the vehicle.
- Verifying the asking price and any additional costs.
- Confirming payment and transfer arrangements.
- Ensuring the vehicle meets their intended use and requirements.
A listing on 345Cars should not be treated as a guarantee, recommendation or certification of a vehicle or seller.
8. Transactions Between Users
345Cars does not ordinarily act as a party to transactions between buyers and sellers.
Users are responsible for negotiating and agreeing all transaction terms, including:
- Purchase price
- Deposits
- Payment method
- Delivery or collection
- Inspection
- Ownership transfer
- Registration
- Insurance
- Financing
- Taxes, duties and fees
- Refunds or cancellations
345Cars does not guarantee that a transaction will be completed or that either party will perform its obligations.
Users should exercise caution when making or accepting payments and should avoid sending money to an unknown party without completing appropriate verification.
9. Fraud and Suspicious Activity
345Cars takes marketplace safety seriously.
You must not use the Platform to conduct fraudulent, deceptive or unlawful activity.
Examples include:
- Fake vehicle listings
- Stolen vehicles
- False identities
- Misrepresentation of vehicle condition
- Fake documents
- Fraudulent payment requests
- Advance-fee scams
- Phishing
- Money laundering
- Attempting to obtain another user's personal or financial information
- Creating multiple accounts to deceive users
- Impersonating another person or business
If you believe a listing, account or communication is suspicious, please report it to 345Cars through the available reporting or contact channels.
10. Prohibited Listings and Activities
You must not use 345Cars to:
- Advertise vehicles you are not authorised to sell or advertise.
- Post false, misleading or fraudulent information.
- Advertise stolen or unlawfully obtained property.
- Advertise illegal goods or services.
- Upload content that infringes another person's intellectual property rights.
- Harass, threaten or abuse another user.
- Collect or misuse another user's personal information.
- Spam or send unsolicited commercial communications.
- Use automated systems, bots, crawlers or scraping tools without written permission.
- Attempt to interfere with the operation or security of the Platform.
- Introduce malware, viruses or other harmful code.
- Circumvent security or access controls.
- Create accounts for deceptive or fraudulent purposes.
- Use 345Cars for purposes that violate applicable law.
11. Listing Content and Photographs
When you upload photographs, descriptions, videos, logos or other content to 345Cars ("User Content"), you confirm that you have the necessary rights and permissions to use that content.
You retain ownership of your User Content.
However, by submitting User Content to 345Cars, you grant 345Cars a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, distribute, format, modify and use that content as reasonably necessary to operate, promote and improve the Platform and its services.
This licence continues for as long as reasonably necessary for these purposes, including where copies of content may remain in backups or promotional materials.
345Cars may remove User Content that violates these Terms or that we reasonably believe is inappropriate, misleading, unlawful or harmful.
12. Listing Removal and Moderation
345Cars may review, edit, restrict, reject, suspend or remove listings or User Content at its discretion where reasonably necessary to:
- Enforce these Terms.
- Protect users.
- Prevent fraud or abuse.
- Comply with legal obligations.
- Maintain the quality of the marketplace.
- Investigate suspicious activity.
- Protect the security or operation of the Platform.
345Cars may also suspend or terminate accounts associated with repeated or serious violations.
13. Prices and Listing Information
Prices, vehicle information, availability and other listing details are provided by sellers unless specifically identified as information provided by 345Cars.
345Cars does not guarantee that listing information is accurate, complete, current or error-free.
Sellers are responsible for correcting inaccurate information.
345Cars may display estimated, promotional or third-party information where appropriate. Such information should be independently verified before a transaction is completed.
14. Fees and Paid Services
Some 345Cars services may be offered for free, while other services may require payment.
Where a paid service is introduced, the applicable price, payment terms, duration, renewal terms and other conditions will be presented before purchase.
Unless otherwise stated, fees paid for promotional or listing services are not refundable once the relevant service has been provided or activated.
345Cars reserves the right to change its fees and paid services. Changes will not affect services already purchased except where permitted by the applicable terms.
15. Communications
By using the Platform, you may communicate with other users through contact forms, messaging features, email, telephone links or other communication tools.
You are responsible for the content of your communications.
You must not use these features for spam, harassment, fraud, threats, misleading advertisements or other prohibited activity.
345Cars may restrict communication features where necessary to protect users or the Platform.
16. Third-Party Services and Links
The Platform may contain links to third-party websites, payment providers, financing providers, inspection services, insurance providers or other external services.
345Cars does not control and is not responsible for third-party websites, services, products, policies or content.
Your use of a third-party service may be subject to that provider's own terms and privacy policies.
17. Intellectual Property
The 345Cars name, logo, branding, website design, software, graphics, text, photographs created by 345Cars, databases and other Platform materials are owned by or licensed to 345Cars and are protected by applicable intellectual property laws.
You may use the Platform for its intended personal or business marketplace purposes.
You may not copy, reproduce, distribute, modify, sell, license, reverse engineer or commercially exploit 345Cars materials without prior written permission, except where permitted by law.
18. Data and Privacy
345Cars collects and processes personal information in connection with operating the Platform.
Our collection, use, storage and disclosure of personal information is described in our Privacy Policy.
By using 345Cars, you acknowledge that your personal information may be processed in accordance with that Privacy Policy and applicable Cayman Islands data protection requirements.
The Cayman Islands Data Protection Law establishes obligations concerning the fair and lawful processing, security, retention and use of personal data. (legislation.gov.ky)
19. Cookies and Similar Technologies
345Cars may use cookies and similar technologies to operate the Platform, remember preferences, analyse usage, improve functionality and support marketing activities where applicable.

20. Availability of the Platform
We aim to keep 345Cars available and reliable, but we do not guarantee that the Platform will always be available, uninterrupted, secure or error-free.
The Platform may occasionally be unavailable due to maintenance, technical problems, security incidents, third-party services, network issues or circumstances beyond our reasonable control.
21. No Warranty Regarding Vehicles
345Cars does not manufacture, inspect, own or sell vehicles advertised by third-party sellers unless expressly stated otherwise.
To the maximum extent permitted by applicable law, 345Cars does not warrant or guarantee:
- The condition of a vehicle.
- The accuracy of a listing.
- The ownership of a vehicle.
- The legality of a sale.
- The identity or reliability of a seller or buyer.
- The availability of a vehicle.
- The suitability of a vehicle for a particular purpose.
- The completion of a transaction.
- The payment or performance of either party.
Buyers and sellers must conduct their own due diligence.
22. Limitation of Liability
To the maximum extent permitted by applicable law, 345Cars and its owners, directors, employees, contractors, affiliates and service providers will not be responsible for losses arising from transactions or interactions between users, including losses relating to:
- Vehicle defects or damage.
- Misleading or fraudulent listings.
- Failure to complete a transaction.
- Payment disputes.
- Vehicle ownership or title disputes.
- Personal injury or property damage arising from a transaction or test drive.
- Loss of data.
- Unauthorised access to accounts.
- Third-party services.
- Website interruption.
- User-generated content.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
23. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless 345Cars and its owners, directors, employees, contractors and service providers from claims, losses, liabilities, damages, costs and expenses arising from:
- Your use of the Platform.
- Your violation of these Terms.
- Your User Content.
- Your violation of another person's rights.
- Your dealings or transactions with another user.
- Your violation of applicable laws or regulations.
24. Account Suspension and Termination
You may stop using the Platform at any time.
345Cars may suspend, restrict or terminate your access where we reasonably believe that:
- You have violated these Terms.
- You have engaged in fraudulent or unlawful activity.
- Your account creates a risk to other users or the Platform.
- Your activity may expose 345Cars to legal or security risks.
- We are required to do so by law.
- The Platform or a particular service is discontinued.
Termination does not affect rights or obligations that arose before termination.
25. Changes to These Terms
345Cars may update these Terms from time to time.
When material changes are made, we may provide notice through the Platform or other reasonable means.
The updated Terms will become effective on the stated effective date.
Your continued use of the Platform after the updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by law.
26. Governing Law
These Terms and your use of the Platform are governed by the laws of the Cayman Islands, unless applicable law requires otherwise.
Subject to any mandatory legal rights available to you, the courts of the Cayman Islands will have jurisdiction over disputes arising from or relating to these Terms or your use of the Platform.
27. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or modified to the extent necessary to make it enforceable, where permitted by law.
The remaining provisions will continue in full force and effect.
28. Entire Agreement
These Terms, together with any additional terms specifically applicable to particular 345Cars services and our Privacy Policy, constitute the agreement between you and 345Cars concerning your use of the Platform.
They replace any previous terms relating to your use of the Platform, except where expressly stated otherwise.
29. No Waiver
If 345Cars does not immediately enforce a provision of these Terms, that does not mean that 345Cars has waived its right to enforce that provision later.
